In 1808 the suit of Scott v Nesbitt was heard by Lord Eldon. The account of the suit set out the background: Arnold Nesbitt had entailed his one-third of the estate on his natural son Arnold Nesbitt and his make here, failing whom to his nephew John Nesbitt and his male heirs. John Nesbitt and his partners Edward Stewart and John Nesbitt the younger were bankrupt 13/04/1802. Jacob Franks had taken on the consigneeship himself for the whole estate. In reaching his judgement (which concerned payments by Franks of claims for earlier advances made by the Nesbitts, which a creditor of Arnold Nesbitt contested), Lord Eldon stressed 'the nature of a West India estate, and how far it differs from a mere estate of land in this country...the different nature of landed property in the West indies.' By this he appears to have meant not the presence of enslaved people, but the dependence on the consignee system. Francis Vesey (ed.)
