Penelope Tomlinson

Biography

Youngest of five surviving daughters of John Tomlinson junior of Antigua (d. 1753) and his wife Jane Mackinnen (d. 1736). Her father was Chief Baron of the Exchequer 1744, Member of Council 1745, President of Council and Colonel of Milita 1752; in his will dated 29/05/1753, he left £1000 and 2 'negros' to each of his five daughters and the residue of his estate to his son John. When this son John died, under his will (proved in 1761) he left various legacies and named his five sisters as his residuary legatees.

By the time Penelope Tomlinson wrote her will in 1805, she was the sole surviving sister and names no nieces or nephews. She left legacies to various Mackinnons, the children of her first cousin on her mother's side, and various Whites, the children of her eldest first cousin on her father's side. She left Tomlinson's estate in Antigua to William White, the eldest son of her first cousin Michael White. However, the compensation for Tomlinson's was awarded to the executors of Maria White (q.v.) for a mortgage of £10,000 and upwards.

The executors of Maria White were Thomas Tomlinson Crisp Molyneux Montgomerie and Crisp Molineux Montgomerie, the sons of another of Penelope's cousins, Elizabeth Montgomerie nee White.

The initial claimant for Tomlinson's was John Osborn as owner-in-fee. His relationship to the Tomlinson family has not yet been established.

Described as of Antigua and a spinster when she wrote her will, 18/07/1802.

To John White, son of Michael White & Mary his wife (late Mary Hussey) & grandson of the said Michl White decd, £200 st. at 15 & if he die then to his sister Lydia White £100,& to his sister Elizth. Hamilton White £100. To Wm White, son of the said Michl White & Mary (heretofore Lee), £200 st. To Ann Byam Kerby, dau. of Thos. N. Kerby, £105 st. All residue to my Ex’ors in trust, to pay rents to Wm White for life, & then to his 1st son & in default to his brother Michael White, then to his brother Robt. White. Trustees to be Ex’ors. 1st Codicil dated 5 Jan. 1805. Power to trustees to let my plantation called Tomlinsons & houses in High Street, St John’s.

2nd Codicil dated 28 Nov. 1805. All my real estate to my kinsman Wm White of Antigua, Esq., in fee simple & not in trust. Witnessed by Rowland Burton, George McKerran. Before Lord Lavington was sworn George Ross McConell of Antigua, writing clerk.

Residuary co-legatee of her brother John Tomlinson of Antigua will proved 21/01/1761. At some stage between 1760 and 1806, Penelope Tomlinson apparently became the sole owner of Tomlinson by virtue of the deaths of her four sisters.
